Summary of terms and their meanings:
"Buyer" - The person who agrees to purchase the Products from the Osprey Gundog Equipment subject to these Conditions whose details may be set out overleaf;
"Conditions" - The terms and conditions of sale set out in this document;
"Delivery Address" - The address for delivery of the Products which shall be the Buyer's entered delivery address on completion of a purchase.
"Products" - The goods which the Osprey Gundog Equipment is to supply to the Buyer in accordance with these Conditions and which are listed on the Order Acceptance;

Basis of Sale
The Conditions here apply to the sale of goods entered into by Osprey Gundog Equipment. By placing an order with the Osprey Gundog Equipment the Buyer agrees to deal with the Osprey Gundog Equipment on these Conditions not withstanding your statutory rights.
No variation to these Conditions shall be binding unless made in writing specifying both which clause is to be varied and full details of such variation and signed on behalf of each of the Buyer and Osprey Gundog Equipment.
Sale and Purchase
The Buyer agrees to purchase the Products from the Osprey Gundog Equipment and Osprey Gundog Equipment agrees to sell the Products to the Buyer.
Payment must be made in full and confirmed before Osprey Gundog Equipment will process or dispatch any products unless an agreement has been made in writing with the Buyer.
The Buyer shall not be entitled to cancel in whole or in part any order which Osprey Gundog Equipment has already processed or dispatched.
If a cancelation occurs before processing but after payment Osprey Gundog Equipment will refund the full amount. A fee may be applied to the cancelation if any third party involved charges a fee to Osprey Gundog Equipment.
The Osprey Gundog Equipment reserves the right to make any changes in the specification and description of the products.
Delivery of Goods
Osprey Gundog Equipment shall use its reasonable efforts to deliver the Products to the Buyer at the Delivery Address on or around the Estimated Delivery Date.
The Buyer shall be deemed to accept the Products on delivery notwithstanding any late delivery by the Osprey Gundog Equipment.
If the Buyer fails to take delivery of the Products or fails to give the Osprey Gundog Equipment adequate accurate delivery instructions before the Estimated Delivery Date, then, without prejudice to any other right or remedy available to the Osprey Gundog Equipment, the Osprey Gundog Equipment may charge any fee charged to the Osprey Gundog Equipment from a third party or delivery company.
Returns and Refunds
If the products are damaged on delivery or less than the correct amount of the products purchased are delivered, then unless the Buyer notifies Osprey Gundog Equipment and the carrier (otherwise than by a note on the delivery note) within three days of delivery no claim against the Osprey Gundog Equipment may be made in respect of damage to or short delivery of such Products.
Osprey Gundog Equipment can accept returns of purchased products only in the following circumstances.
- The products delivered are not the products ordered by the buyer.
- The products delivered are damaged whilst packaged or in transit.
- The products are not as described on the Web Site.
Should the buyer wish to return products to Osprey Gundog Equipment because the buyer incorrectly selected the products, the buyer will be responsible for the entire postage and handling costs.
Any re-funds due to the Buyer will only be applied after the goods have been returned to Osprey Gundog Equipment and any due charges deducted from refund amount.
Prices and Payment
Osprey Gundog Equipment Web Site uses a third party provider for accepting payments. This provider is wholly responsible for the guaranteeing the usage and storage of all payment information entered. Osprey Gundog Equipment does not store any sensitive information, payment information including credit card numbers and therefore cannot be held responsible should any of this information be used fraudulently. The payment provider used by Osprey Gundog Equipment guarantees that payments and sensitive information will remain secure therefore this provider should be contacted if fraudulent activity is detected.
Osprey Gundog Equipment reserves the right, by giving notice to the Buyer at any time before delivery, to increase the price of the Products to reflect any increase in the cost to Osprey Gundog Equipment which is due to any factor beyond its control, any change in delivery dates, quantities or specifications for the Products which is requested by the Buyer or any delay caused by any instructions of the Buyer or failure of the Buyer to give Osprey Gundog Equipment adequate information or instructions.
The price is exclusive of any applicable value added tax, Import Tax or local taxes that may apply outside the United Kingdom, which the Buyer shall be additionally liable to pay to the authorities concerned or to Osprey Gundog Equipment should the charge be applied to Osprey Gundog Equipment.
If full payment is not received by Osprey Gundog Equipment then without prejudice to its rights Osprey Gundog Equipment is entitiled to sell the ordered products to any other buyer.
Should payment be cancelled after dispatch of the products Osprey Gundog Equipment will be entitled to require the immediate return to Osprey Gundog Equipment of all goods and the Buyer hereby agrees to reimburse to Osprey Gundog Equipment upon demand the Osprey Gundog Equipment's costs or expenses in recovering such goods.
Warranty and Liability
Osprey Gundog Equipment warrants that the products at the time of delivery be free from defects in material and workmanship for a period of Six from the date of delivery provided that Osprey Gundog Equipment shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage or negligence by the Buyer or persons using the Products, abnormal working conditions, failure to follow Osprey Gundog Equipment's or manufacturers instructions (whether oral or in writing), or misuse or alteration or repair of the Products.
Osprey Gundog Equipment shall be under no liability if the total price of the Products has not been paid.
Law and Jurisdiction
The construction, validity and performance of the Contract is governed by the laws of England and Wales the parties accept the jurisdiction of the English Courts.
